These Terms & Conditions ("Terms") govern your use of www.flysmarttravel.agency and the flight booking, reservation, and seat upgrade services (the "Services") provided by FlySmart Travel LLC, a company registered at 30 N Gould St STE R, Sheridan, WY 82801, United States. By using our Services, you agree to these Terms.
1. Our role as a travel agency
FlySmart Travel LLC is an independent travel agency. We are not an airline, and we do not operate flights. We act as an intermediary between you and the airlines whose flights we search and book. Airfares, schedules, baggage policies, seat availability, and fare rules are determined solely by the airline, not by us.
2. Booking process and fees
When you request a booking, we will provide a quote showing the airline base fare, applicable taxes and carrier-imposed fees, and our service fee as separate, itemized amounts. A booking is only made after you approve the total price. Our service fee compensates us for searching, booking, and supporting your reservation and is separate from, and in addition to, the airline's fare.
3. Payment
Payment is due at the time of booking unless otherwise agreed in writing. We accept the payment methods shown at checkout or quoted to you directly. You represent that any payment method you provide is one you are authorized to use.
4. Accuracy of information
You are responsible for providing accurate passenger names (matching government-issued ID or passport exactly), dates of birth, and travel document information. We are not responsible for additional fees, denied boarding, or denied entry resulting from inaccurate information you provide.
5. Travel documents and entry requirements
You are responsible for ensuring you hold a valid passport, visa, and any other documentation required for your itinerary, including compliance with destination country entry requirements and health or transit regulations. We recommend confirming requirements with the relevant embassy or consulate and the U.S. Department of State (travel.state.gov) before booking international travel.
6. Schedule changes, delays, and cancellations by the airline
Airlines may change schedules, substitute aircraft, delay, or cancel flights for operational, weather, or other reasons outside our control. Where an airline cancels or significantly changes a flight, we will assist you in seeking the rebooking, credit, or refund the airline offers, in accordance with our Refund Policy, but we are not liable for the airline's own schedule decisions.
7. Seat upgrades
Seat upgrade requests are subject to airline inventory and fare rules at the time of ticketing. Requesting an upgrade does not guarantee its availability. Upgrade pricing is set by the airline and may change between the time we quote it and the time it is confirmed.
8. Limitation of liability
To the maximum extent permitted by law, FlySmart Travel LLC's total liability for any claim arising from our Services is limited to the amount of the service fee you paid to us for the relevant booking. We are not liable for indirect, incidental, or consequential damages, including missed connections, lost income, or costs arising from an airline's acts or omissions.
9. Prohibited use
You agree not to use our Services for fraudulent bookings, to misrepresent traveler identities, or to violate any airline's contract of carriage or applicable law.
10. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Any dispute arising from these Terms or our Services will first be addressed through good-faith negotiation; if unresolved, it may be brought in the state or federal courts located in Wyoming, unless applicable consumer protection law provides otherwise.
11. Changes to these Terms
We may revise these Terms from time to time. The "Last updated" date above reflects the most recent version. Continued use of our Services after changes take effect constitutes acceptance of the revised Terms.
